Brent,
Members of the HOA team have spent significant "volunteer" time to
continue to work toward resolution of a number of items including the latest
effort to propose a lease agreement between Legacy Properties and the HOA
following the dedication of the Owners Clubhouse. We have asked the input
of an attorney who has experience in this realm and have followed her
recommendations in a number of areas. The proposed agreement which you
have received was in no way intended to be one - sided. We would
appreciate your response to specific concerns and alternative recommendations
instead of sarcastic replies. We want this resolved as much as you do, and we
have felt that we have been making very good progress to that end.
Here's a simplified version of the current discussion:
1. The owners clubhouse is advertised and has been promoted and promised
as a significant amenity to those who own and use the condominiums at Lakeside
Village. The clubhouse is to include gathering space for use by owners as well
as access to exercise room, equipment, the pool and spa areas.
2. The sign outside of the Owner's Clubhouse reads "Real Estate
Sales Office" and "Reception and Check-in". Legacy
properties currently uses 100% of the Owner's Clubhouse for its business of
sales and rentals of condominiums. As such, it seems quite clear
that if Legacy is going to use all or a significant portion of the Owners
Clubhouse for sales and rental activities including desks and other office
equipment, a reception area, etc., that Legacy would expect to pay for the use
of the HOA owned facility, just as other renters pay current homeowners for the
use of their homes.
3. When the Owner's Clubhouse is dedicated to the HOA, as deemed by the
County, obviously some adjustments will need to made to accommodate the use of
the Clubhouse by owners and guests without interfering with or being interfered
by the business being conducted by Legacy Properties. At the very least,
access to a gathering space for parties or meetings of homeowners, the exercise
room and restrooms will need to be established.
Please continue our mutual effort to move this toward a fair and equitable
solution. A lease agreement is a necessary entity in order to protect
both parties. It is a wise business consideration for all involved.
