I sent the email
below after our meeting on the 4th. You and I have talked on the phone
since then, but we think it would be good for the Management Team to meet with
you to review our progress. Both on the items below and on the bullet
list.
During our last phone conversation on
Tuesday September 9, you were going to be in contact with the county concerning
the declaration of the clubhouse. Have you gotten any further
info?
Let us know when you could meet with us and we will get a couple of
the Management Team members to meet with you. As you and I discussed, we would
like to have a meeting once a month to review open items. Can we schedule these
meetings?
There has been a lot of progress here at Lakeside over the last
couple of weeks. The missing landscaping is in the process of being
installed, the entrance to one of the tennis courts is available again, the
sprinkler systems are being repaired. We all appreciate this forward
progress.

Team,
Roody has talked with Brent via phone and the following proposal
was discussed. At Brent's request I then discussed it with Shantele
yesterday evening. We discuessed these two points(as well as the
bullet list) and this is the results to date. Please review and
comment.
1)Dues:
Legacy is offering to pay all of the outstanding HOA
dues on buildings 1, 2 and 3, and continuing paying the full monthly assessment
for all units owned by Legacy. Legacy is also willing to pay
all
expenses on Legacy titled units in buildings 4, 5 etc, with one exception:
For all future buildings (beginning with building #4) the HOA would not add the
"reserve portion" of the monthly assessment to Legacy-owned units for the first
twelve months following their dedication.
We think this an acceptable
solution. It does required a unanimous vote of the membership and since
phase 5 does not come online until December, we can have this vote at the annual
meeting.
Are we in agreement to this point? YES, but Legacy may
want to bring this to a vote sooner.

2)Clubhouse:
Although not required by the CC&Rs, the Management
Team has supported use of the clubhouse as a sales office until the end of the
current Declarant period (2007 or sale of all units), under the following
conditions:
·Legacy pays a nominal rent for the sales office and rental area
after the clubhouse has been dedicated. For Example: Rent of $1 per year. Plus
maintainance of the interior of the clubhouse.
·Homeowners are allowed access
to the owners' portion of the clubhouse during reasonable hours (6:00 a.m. to
10:00 p.m.)
*Lease of clubhouse between Legacy and the Lakeside Village
homeowners to be reviewed on an annual or bi-annual basis as part of the annual
meeting.
Are we in agreement to this point? YES, Shantele commented that
they would like the lease to continue through the declarent period. She siad
they would cover electric, gas, landscaping, and also do the daily pool
inspections instead of a rental dollar amount.
Shantele commented that they
would like to declare the clubhouse prior to phase 5 declaration.
This really depends on the county. She said she would check into
this.

points outlined for a joint letter to the homeowners.
The Management Team
will provide a lease document for Legacy to review. (I am getting an example
from the HOA attorney).
Other Items:
We need a copy of the plat Legacy
plans to submit to the county.
